Black Lotus Wellness Center is a wellness franchise providing massage, stretch, and skin care services. Our brand is built with the belief that therapeutic massage, stretch, and facials are integral components of Total body wellness and keep your body working.

 

Payment & Fees:

• Payment is due at time of booking through our online secure payment system.
• Service fees listed at time of booking is the amount you will be charged.
• From time to time due to location, time of the day, length of massage and number of massages the prices may change. The final cost will be listed before you enter your credit card information.
• Gratuity is not included in the massage price. Gratuities are appreciated in cash upon completion of the massage.

Cancellations:

• All reservations shall be supported by providing a valid credit card.
• Cancellation made before 24 hours of your appointment time will be refunded in full within 7-14 business days.
• Cancellations made before 5 hours of your appointment time on the same day will be refunded in half within 7-14 business days.
• If you do no not show up for your scheduled appointment you will be charged full price for the scheduled service.
• Therapist retains the right to terminate massage at any time for inappropriate conduct from the client. This includes but is not limited to inappropriate touching, vulgar language, harassment or intoxication on the part of the client. If a massage is terminated no refund will be paid to the client.
• Black Lotus Wellness Center retains the right to arbitrate disputes between contractor and client and determination shall be final.

Medical Waiver & Disclaimer:

Black Lotus Wellness Center provides therapeutic massage therapy services. Client agrees to provide any known medical conditions that might be affected by massage services. Black Lotus Wellness Center is unable to provide pregnancy massage or post-surgical rehabilitation massage. It is the responsibility of the client to disclose any medical conditions to Black Lotus Wellness Center before the start of your massage. Medical conditions include but are not limited to: Heart conditions, stroke, diabetes, skin conditions and cancers.

Black Lotus Wellness Center cannot diagnose any medical conditions or provide referral for medical treatment or tests.

Indemnification:

Client agrees to indemnify and hold Black Lotus Wellness Center, officers, contractors and employees, harmless from any claim or demand, including reasonable attorneys’ fees and costs, made by any third party due to or arising out of use of any person or facility provided by Black Lotus Wellness Center.

Responsibility:

Massage Therapists are independent contractors who are solely responsible for their actions in connection with the above. None of the Massage Therapists are employees of Black Lotus Wellness Center. they are independent contractors. Black Lotus Wellness Center is only a referral service providing access to qualified licensed Massage Therapists. Client agrees to hold Black Lotus Wellness Center free from any liability resulting from any actions or interactions of any physical Massage Therapist recommended by Black Lotus Wellness Center.

Liability Cap:

Except where prohibited by applicable law, the aggregate liability of Black Lotus Wellness Center, its affiliates, agents and their respective officers, directors, shareholders, employees, contractors, representative and agents to you for all claims arising from or relating to this agreement, or your use of the services including without limitation, your interaction with any therapist(s) or other customer(s), any cause of action sounding in contract, tort, or strict liability will not exceed the greater of: (A) the total amount received by Black Lotus Wellness Center. from you during the six-month period prior to the act, omission or occurrence giving rise to such liability, or (B) $100.

Privacy:

Any information received from clients shall be deemed strictly personal and confidential and Massage Therapist and Black Lotus Wellness Center. agrees it shall not divulge any information received from client to any person or entity without such clients prior written consent except where applicable by aggregate law.

In exchange for us rendering services to you, you understand, acknowledge, agree and hereby voluntarily accept all
risk and responsibility associated with the services provided by Black Lotus Wellness Center. You hereby waive all claims, assume all liability, and release, hold harmless, indemnify, and agree to defend us (including our affiliates, agents, and employees), Black Lotus Wellness Centers affiliates, from liability for any injury, claim, cause of action, suit, demand, and damages (including without limitation,
personal, bodily, or mental injury, property damage, economic loss, consequential damages, and punitive damages, arising from or related to (1) your failure to disclose any pre‐existing conditions, limitations, or sensitivities; (2) your failure to inform your therapist or esthetician of discomfort or pain during or at the end of the service; (3) your presence on the premises of Black Lotus Wellness Center; and /or (4) any  negligence on our part (including our employees). You further expressly agree that this Assumption of Risk, Release, Waiver of Liability, and Indemnification is intended to be as broad and inclusive as permitted by law and that if any portion of it is held invalid, the balance shall be valid and continue in full legal force and effect. These provisions are binding on your estate, family heirs, administrators, personal representatives, and assigns.

YOU ACKNOWLEDGE AND AGREE THAT YOU UNDERSTAND THE PROVISIONS CONTAINED WITHIN THESE TERMS AND CONDITIONS, HAVE HAD ADEQUATE TIME TO REVIEW SUCH PROVISIONS, ACKNOWLEDGE AND AGREE THAT YOUR CONSENT TO THESE PROVISIONS IS GIVEN IN EXCHANGE FOR US RENDERING SERVICES, AND AGREE THAT THESE PROVISONS APPLY AT EACH VISIT TO BLACK LOTUS WELLNESS CENTER. YOU ACKNOWLEDGE AND AGREE THAT BLACK LOTUS WELLNESS CENTER IS INDEPENDENTLY OWNED AND OPERATED AND YOUR AGREEMENT IS WITH US AND NOT WITH MHF OR ANY OF ITS AFFILIATES. YOU UNDERSTAND AND AGREE THAT YOUR THERAPISTS AND ESTHETICIANS ARE THE EMPLOYEES OF BLACK LOTUS WELLNESS CENTER YOU ACKNOWELEDGE AND AGREE THAT NEITHER BLACK LOTUS WELLNESS CENTER NOR ANY OF ITS AFFILIATES SHALL HAVE ANY LIABILITY FOR (i) ANY OBLIGATIONS OR LIABILITIES RELATING TO OR ARISING FROM YOUR MEMBERSHIP; (ii)
ANY CLAIM BASED ON, IN RESPECT OF, OR BY REASON OF THE RELATIONSHIP BETWEEN YOU AND US; OR (iii) ANY CLAIM BASED UPON ANY ALLEGED UNLAWFUL ACT OR OMISSION BY BLACK LOTUS WELLNESS CENTER.
